Juvenile Detention Hearings  
     
  Release conditions for an arrested Juvenile
Do not let kids talk about facts of their case!  

Misdemeanor

Domestic Violence

  Child is released to Parent or Guardian

 

If family can assure court they can control child and assure safety of victim --Child can be released. 

Explosion 1: There must be a review of the child’s status every 48 hours.

If parents cannot assure court, then shelter or secure detention for 21 days. 

Felony

Depends on Risk Assessment score

The child can be sent home anytime.

 

 

       

 

 
   
   
Youthful Offenders
Who qualifies?        
Client who is at least 18, for offenses committed before 21st birthday  

OR

  What can Court do?  
-Clients who have been transferred from juvenile division  to adult court. l. Place on probation or Community Control with or without adjudicating for no more than 6 years.  

AND

  2. Incarcerate for up to 364 days as condition of probation or Community Control in
county jail or boot camp.
 
-Who has not been convicted of capital or life felony

AND

  3. Impose split sentence : 1-4 years in Department of Corrections followed by probation or Community Control.  

-Who has not previously been classified as a youthful offender.
